On the day of the assault incident, Miller said she came back to their apartment just after midnight and met Lewis sleeping with the lights on. She woke him up and an argument ensued before Lewis threw a pillow at her.

She told the court that Lewis hit her three times with the pillow, pushed her against the wall and then to the ground before dragging her across the floor and grabbing her by the neck. Lewis himself told the court that he was trying to leave the apartment when his girlfriend fell to the floor and grabbed his legs in an attempt to stop him. He went on to say that he tried to free himself by grabbing her, possibly on the throat but with no intention of assaulting her.
